When rganizing a giveaway in Quebec, it is extremely important to pay attention to the laws that apply. In Québec, the Régie des alcools, des courses et des jeux regulates the giveaways.
If the total value of your prize(s) does not exceed $100, the following rules do not apply to your giveaway.
However, if the total value of your prize(s) exceeds $100, here are the steps you need to follow.
1. Get a licence from the Régie des alcools, des courses et des jeux
First, when you want to hold a giveaway, you have to complete the publicity contest notice and pay the licence. Your request must be done within 30 days before the beginning of the contest if the value exceeds $1000, and within 5 days if the value is less than $1000.
How much does it cost?
If the giveaway is worldwide (including Québec), the cost will be 0.5% of the value of the prize(s).
If the giveaway is only in Canada (including Québec), the cost will be 3% of the value of the prize(s).
If the giveaway is only in Québec, the cost will be 10% of the value of the prize(s).
2. Make the giveaway rules available to the public
All rules of the contest must be accessible to the public and must include the following text: “Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement”.
3. Communicate the name(s) of the winner(s)
You have to complete and send this report within 60 days following the date where a prizewinner is named.
